    how much do solicitors claim when they sue for personal injury?
    although most personal injusry lawyers are no win no fee, i wanted to know how much do they charge the other party for their legal expenses, in this situation the claim has been taken to court as small track, less than 5000 case. i..e the personal injury claim itself is not worth more than 5000.
    my solicitor friend informed me the money is not taken out of a settlement, but rather the legal expenses will then be sent to the other party afterwards. nonetheless i wanted to know on average for a good company, how much do they claim off the drivers insurance company who are liable.

      Most solicitors are around £150-200/hour, so it would depend on how much work they need to do in a claim. The money does not come out of any monies awarded to the claimant it is claimed back from the defendants after the claim is concluded. Many cowboy TV no win no fee claims use it as a selling point but all solicitors do it anyway.

    Should i call a personal injury lawyer?
    About 4 days ago this chick hit my truck from behind pretty hard. There was hardly any damage to my rubber bumper but the police and ambulance came and did a report.

    Since then my lower back has been hurting off and on and there is some tightness so i plan on seeing an orthopedist soon.

    Should i call the chick’s insurance company first or should i call an ambulance chaser to file a claim?
    Actually, i have been feeling mesothelioma-ish lately….

      Get checked out by an orthopedist, if he says that there is some damage/injury, then you need to call an attorney that you know, not one of those ambulance chasers who advertise on t.v. Ask your friends or a lawyer you have used in another field to recommend an attorney. I’m sure there is a rating site somewhere if you don’t know of anyone who has used a personal injury lawyer in the past. You don’t want to try and deal with the insurance company, they will never be helpful. You don’t have to file a suit, but you should let the attorney handle the grunt work or at least direct you on the best course of action. Most good attorneys will tell you how to handle something and tell you that if it gets to a certain point then come back to them and they will handle it.

    Is my personal injury claim capped by a drivers policy limit?
    I was recently run over by a vehicle as I was walking through a parking lot. The injuries almost took my life. As a result I have already required emergency life saving surgery once, in which I lost my spleen and almost a kidney (the doctors said there was barely enough of it alive to leave it in). I also incurred other injuries to my ribs and spine. My back has not healed and will need further treatment as time goes on. The removing of my spleen will affect me for the rest of my life as I am now more likely to get infections and illnesses that could become life threatening at a much more rapid pace. I missed over two months of work and have recently just returned on a light duty basis because I had no income and have a family to feed.

    My question is that my lawyer is saying my settlement will be capped by the drivers insurance policy. So if she has the mini. $20,000 policy, that is all I get. This does not seem right to me, as I have heard of huge settlements in the past for accidents like this and for pain and suffering. I have had quite a bit of both after spending 24 days in the ICU and missing an entire month of my then two month old sons life. My fiance has also had to go through a lot, can that be a factor? Is my settlement really capped at her policy limits or can I get above and beyond that from her insurance company? There is no telling how this will affect me long term (the loss of a spleen as I said leaves me much more open to illness, I must get a flu shot every year and other immunizations every year. There is no telling how much time off of work I will miss in the years to come as a result of these illness’. Also the spleen has been linked heavily as a cause of early death in patients who have had theirs removed.)

      You get the amount covered by the insurance, and then file a Civil Suit for the rest. I would be getting another attorney if he actually told you that.

    How fast can a personal injury claim against an insurance company take?
    I’ll try and keep this simple. I had two “friends” jump on my back while I was asleep. They broke my neck and I was in the hospital for 2 months and had neck surgery. Some nurses thought I was going to die when I was brought in to the ER. I am learning to walk all over again and will not be back at work for a long time. This is a life changing injury although my surgeon expects a 100 percent recovery.

    Now I have a lawyer who is going after the homeowners policies of both parties for the full amount of personal injury liability. He thinks he may get some “cash” in 3-4 months. Both parties are cooperating and admit they were at fault.

    How long can something like this really take and can I expect the full amount possible in this case. For example one party has 300,000 coverage for personal injury. Should I expect all of that? My lawyer is old school and wont accept the first number he hears and he has a private investigator getting statements and following up on things.

    Really want to have an idea of how much waiting and how much money a situation like this will turn out.

    ICBC Personal Injury Claim Advice?
    I was driving my dad’s car to take my parents to the airport. I had to stop suddenly and to avoid hitting the cars at a red light in front of me I swerved to the curb lane and smacked dead on into a pole. No other vehicles were involved. I believe the brakes didn’t work. My dad and I were not seriously injured but my mom was. No broken bones or anything but severe pain. My parents are seniors in their 70′s. My dad has early Alzheimers so she was his caregiver and she also did babysitting for my nephew which she was paid for. The car was a write off and they refused to check the brakes for fault.

    How do we deal with ICBC so we get all that we are entitled to? Do we need a lawyer to sue for damages or will ICBC award damages to her automatically? Any advice dealing with ICBC would be appreciated. Thank you!

      First off when were the brakes last serviced? If it was recent and you have receipts to prove it then liability rests with the shop. If you don’t have proof of repairs or if the brakes weren’t serviced then there is no liability with anyone other than the owner of the car for improper maintenance and NO your insurance company will not inspect the brakes.

    Five years ago, my husband was out in the company vehicle when he was hit from behind by another driver. He suffered a broken back and ended up having his lower spine fused and has been on pain meds ever since. He got compensation in the area of $90k. However, 2 years ago, another driver hit him again from behind, and ever since, my husband has been in agony. His surgeon claims that the second accident, “Might have aggrivated the injury a little”, and the driver’s insurance company have made an offer of just $15k… which drops down to $4k after lawyer fees, etc.

    We just feel as though we’ve been kicked in the teeth.. the second accident caused my husband to start having erectile dysfunction problems (he had no problems prior to the second accident) and our lawyer has suggested we take the claim to trial.

    What I want to know is… what are our chances of getting a significantly larger offer than $15k, and would my testimony about the sexual dysfunction make any difference?
    What if we lose at trial… would we still get the $15k regardless?
    How can my husband prove that the problems started BECAUSE of the second accident… and how can the courts prove differently?

    Please, only serious answers guys, as this is a really sensitive issue right now.

    Personal Injury Claim?
    I was involved in a mortorbike accident where the other party was at fault and admitted to it. I racked up $13.5k in ER bills and since then have seens a sports medicine doctor for Type II shoulder seperation and rotator cuff injuries (about $2.5k), plus seeing a physical therapist (10 visits or so). I’m want to settle my case preferable without a lawyer with a fair settlement. I’ve read about the “multiply by 3 rule” and seems that it might not be valid. I’m wondering what a reasonable settlement should be for the pain & suffering/ special damages.
    Could I get the services of a 3rd part adjuster to get a better idea?
    This said accident happened in the bay area.

      From an adjuster’s point of view – there is no such thing as a multiply by 3 rule. Basically the adjuster will make you an offer based on the severity of your injuries, your treatment, and pain and suffering will be based on a combination of those things as well as any permanency issues – and if it had an affect on your life. You were on a motorcycle, you obviously have more than just “soft tissue” injuries – and have racked up what about $16-$17K in special damages (plus any wage loss?) if it’s a good insurance company, they’ll make you a fair offer.

      Just FYI – if they do make an offer, it is always up for negotiation – just know your arguing points. Make your case. If they can justify an increase in the offer, then they will increase the offer – so make VALID not generic arguments. AND say the insurance company does make you an offer and you don’t like it, so you go get an attorney, chances are you won’t get much more than if you were to negotiate it yourself – and the attorney will take anywhere from 25% to 40% off the top – do the math – you’ll get more without an attorney no matter what you settle it for.

    I was in a car accident a year and a half ago and hurt my back. I have been treated since then to help resolve the issues to no luck. Recently i got an offer from the insurance company to settle this claim. It is a rather large sum of money, but considering the factors is still low. It is quite possible i may have this injury for the rest of my life and have been taking pain medication for it for the past year and a half. I am wondering if their is an amount over the initial offer that they usually go to without having to go to court. double, triple, anything like that. If anyone has any info that would be great. And just a side note, i do not have a lawyer for this.
    The current offer is at $38,000

      What did they offer you? Does it cover all medical expenses? does it give you a couple grand for your life of taking pain medication? does it give you enough for paid time off work? Did it cover fora new car?

      if all those answer yes, you wont get more than that. If you want more, then you may need a lawyer, who will take that portion away from your money anyways. Ive been in this situation, and my advice to you would to be to settle for a reasonable amount, because you dont know whent he tables are going to turn on you, and staying up at night,w orrying if their claim is going to be covered

    Your car gets clipped, you complain of back pain, you go see a solicitor, couple months later you get a few thousand pounds. How much does the solicitor make? Say you get 2000, do they get 2000 also?

    get an adance on a personal injury claim?
    Hi,

    My friend was injured in an apartment he was living at ( a 10 chandelier fell on his head) about 3 years ago and has a lawsuit pending. He now is in need of financial assistance and still doesn’t know how long his lawsuit is going to take, since he is now waiting for surgery to his neck. Can he get an advance from his lawyer. He lives in British Columbia. Thanks for all answers in advance.

      As an American, I cant speak to Canadian law.

      But here in the States, you could not get a lawyer to advance money, other than court costs and the like.

      But there is a new wrinkle out there that can be either a life-saver or a total rip-off. There are now financial institutions that will review your lawsuit with your lawyer and decide if they think you will win and, of course, how much they think you would win.

      Then if they think you will prevail they will pay you money in exchange for getting the proceeds from the suit. If a person wins, they have had their money, though a lesser sum, up front and the loan company gets the settlement. If you lose, they go home empty-handed.

      Be careful of this. I think its a rip-off but have had no experience to judge by. Just be very careful. Someone might get, say a dime on the dollar and then have to follow through on the suit so the loan company gets paid.

      Here is one of those companies. But I don’t know anything about them. Just that they advertise their lawsuit advance plan on TV.
